The information in these databases is constantly updated.

Acts in force

Information about new titles is added when they are passed or published (whether they are in force or not). Changes are usually updated within 2 working days of the amending provision/s commencing, except in busy periods. Busy periods for changes to legislation are early January and early July of each year. The database:
Contains information about
  • Acts passed (both public and private)
  • Reprints
  • Government Gazettes
  • Imperial Acts (UK) adopted in WA that are in force.
Does not contain information about
  • Treasury Acts (Appropriation Acts, Loan Acts, Supply Acts, Treasurer's Advance Authorisation Acts)
  • Reserves Acts, Road Closure Acts and Railway Acts
  • Acts that are spent or that have been repealed or have expired, even if the operation of some or all of the provisions continue to some extent (e.g. for saving or transitional purposes). For information about these Acts see “Acts that have ceased to be in force“.
 

Assent, commencement and ceasing information for Acts

Commencement, repeal or expiry details will usually be included within 2 working days of publication. The database:
Contains information about
  • All Acts that have been passed in WA, including assent dates, commencement details and, where applicable, were repealed or otherwise ceased.
  • It also includes all Imperial Acts (UK) that have been adopted in WA and the WA Acts that adopted them.
    Note -
    The year and number of a WA Act is shown in different ways depending on the year -
    • From 1829-1902, regnal years and numbers were used (e.g. 37 Vict. No. 13)
    • From 1903-1964, both regnal years and numbers, and calendar years and numbers, were used together (e.g. the Act 2 Geo. V No. 9 is also No. 1 of 1912). Note that the numbers do not always match
    • From 1965 onwards, only calendar years and numbers are used (e.g. No. 13 of 1984)
    • All calendar years and numbers are abbreviated to a year/number format (e.g. 1984/013 refers to Act No. 13 of 1984).
    Some WA Acts do not contain short titles. These Acts are given titles editorially to reflect their subject matter and indicate their year of enactment in parentheses, without the word 'Act'. e.g. 'Abattoirs (1842)'.
    If an Act has expired, the expiry date is shown.
    If an Act has been repealed, the repealing Act number is shown.
    A reference to an Act that repeals another Act uses a year/number format e.g. 1984/013.
Does not contain information about
  • local laws made by or on behalf of local governments
  • town planning schemes
  • proclamations, orders in council, notices, resolutions or other instruments which are of limited or temporary operation or application, or not considered to be of general interest.
 

Acts amended by Acts passed this year

An Act passed in the current year will usually be included in the database within 2 working days of receiving the Royal Assent. The database contains information about Acts that will be affected by Acts passed to date in the current year. They are listed in alphabetical order of the Act to be affected.

The database contains information about Acts that will be affected by the Acts passed to date in the current year. They are listed in alphabetical order of the Act passed to date.
 

Acts that have ceased to be in force

The information in this database relates to Acts that have been repealed or have expired or otherwise ceased to be in force. Information relating to a particular Act will usually be included within 2 working days of it ceasing to have effect. The database:
Contains information about
  • Principal (not amending) WA Acts
  • Imperial Acts (UK) adopted in WA
Does not contain information about
  • Treasury Acts (Appropriation Acts, Loan Acts, Supply Acts, Treasurer's Advance Authorisation Acts)
  • Reserves Acts, Road Closure Acts and some Railway Acts.
 

Acts that will expire

Information relating to a particular Act will usually be included within 2 working days of the sunset provision coming into operation. The database contains information about Principal Acts that are in force which contain an expiry provision relating to a future date of event (a 'sunset provision'). It shows the relevant section number and expiry date.
 

Acts with administering portfolios and public sector agencies

Information relating to a particular Act that has been committed to a Minister will usually be included within 2 working days of the Executive Council minute being signed by the Governor in Executive Council. The database contains information about Ministers responsible for the administration of particular Acts (or part of them) and the Public Sector Agency through which they are administered. The Allocations are approved by the Governor.
 

Subsidiary legislation in force

Information relating to regulations, rules and selected legislative instruments will usually be included within 2 working days of commencement. The database contains information about Principal Acts under which certain subsidiary legislation and certain other statutory instruments have been made. Under each of those Acts, the subsidiary legislation and other statutory instruments, and amendments are shown.
Does not contain
  • local laws made by or on behalf of local governments
  • town planning schemes
  • certain proclamations, orders, notices, resolutions or other instruments which are of limited or temporary application, or not considered to be of general interest
  • proclamations fixing commencement dates of Acts, or orders or proclamations effecting amendments to Acts (for these see Tables 1 and 2)
  • regulations, rules etc. that amend an Act (see "Acts in Force")
  • subsidiary legislation that ceases to have effect because of section 42 of the Interpretation Act 1984.

Subsidiary legislation that has ceased to be in force

Information relating to a particular regulation, rule and selected legislative instruments will usually be included within 2 working days after it ceases to be in force. The database contains information about Principal regulations, rules, and selected legislative instruments that have been repealed or have otherwise ceased to be in force.
Does not contain
  • local laws made by or on behalf of local governments
  • town planning schemes
  • certain proclamations, orders, notices, resolutions or other instruments which are of limited or temporary application, or not considered to be of general interest
  • proclamations, orders, notices, resolutions or other instruments which are of limited or temporary application, or not considered to be of general interest.

Legislation affected by Bills currently in Parliament

Information relating to a particular Bill will usually be included within 2 working days of the Bill being introduced into Parliament. The database contains information about Legislation (Acts and Subsidiary legislation) that will be amended or repealed by Bills that are currently in Parliament. It is listed in the alphabetical order of the legislation to be amended by the Bill currently in Parliament.
