Water Services Licensing Act 1995

Water Services Licensing (BHP Billiton Nickel West Pty Ltd) Exemption Order 2012

Made by the Governor in Executive Council under section 19 of the Act.

1. Citation

This order is the Water Services Licensing (BHP Billiton Nickel West Pty Ltd) Exemption Order 2012.

2. Commencement

This order comes into operation as follows —

(a) clauses 1 and 2 — on the day on which this order is published in the Gazette;

(b) the rest of the order — on the day after that day.

3. Terms used

In this order —

approved entities means the 4 entities (being entities carrying on mining operations near the Kambalda townsite within the Goldfields/South West Controlled Area) with which Nickel West has, immediately before commencement day, a written agreement for the supply by Nickel West of non-potable water for non-domestic purposes;

commencement day means the day on which this order, other than clauses 1 and 2, comes into operation;

Goldfields/South West Controlled Area means the Goldfields/South West Controlled Area (Water Supply and Sewerage Services) constituted by the Goldfields/South West Region Controlled Area (Water Supply and Sewerage Services) Order 1999;

Nickel West means BHP Billiton Nickel West Pty Ltd (ACN 004 184 598);

Nickel West pipelines means pipelines that, immediately before commencement day, are —

(a) owned by Nickel West; and

(b) used for the supply by Nickel West of non-potable water for non-domestic purposes to the approved entities.

4. Exemption

Nickel West is exempt from the requirement under section 18 of the Act to hold an operating licence (water supply services) in respect of the supply by Nickel West, through Nickel West pipelines, of non-potable water for non-domestic purposes to the approved entities.
