Exemption Notice 2013
In accordance with section 7 of the Water Services Act 2012 (Act) Hon Terry Redman MLA, Minister for Water, on 10 December 2013, granted an exemption from section 5(1) of the Act to the Shire of Esperance (the Shire) for the provision of a non-potable water supply for use within the Shire for the watering of parks, gardens and sporting fields.
The exemption is valid for an indefinite period.
Summary of reasons for the decision
Granting of this exemption is not contrary to the public interest.
Granting the exemption will reduce the regulatory burden on the Shire and avoid the costs of licensing the non-potable water supply service.
The risks of the abuse of monopoly power in the provision of this service are low. It is a non-essential service and is operated on a not-for-profit basis.
The public health aspects of the service are regulated by the Department of Health.
