Exemption for St Ives Gold Mining Company Pty Ltd for the provision of water services (non-potable water supply) to Salt Lake Mining Pty Ltd
In accordance with section 7 of the Water Services Act 2012, Hon Dave Kelly MLA, the Minister for Water, has granted an exemption from the application of section 5(1) of the Act to St Ives Gold Mining Company Pty Ltd (ACN 098 386 273) for the provision of water services (non-potable water supply) to Salt Lake Mining Pty Ltd (ACN 162 824 473).
The exempted water services involve the supply of non-potable water for non-domestic purposes.
The exemption will come into effect on the day it is published in the Government Gazette and is valid for an indefinite period.
Summary of reasons for the decision
Granting this exemption is not contrary to the public interest. It is considered that—
• The regulatory burden imposed by licensing this water service would be disproportionately high relative to the public benefits.
• The service is a negotiated commercial arrangement between two industrial parties for the supply of non-potable water for non-domestic purposes.
• The risk of St Ives Gold Mining Company Pty Ltd exploiting its monopoly power is low. The service is operated on a not-for-profit basis to allow mining activities to continue.
